GENERAL TERMS AND CONDITIONS OF PAYNOW SERVICES.

 1. Company.
Paynow services are provided by Paynow Travel Care S.L.U., NIF B70908363, with registered office at Calle Domingo J. Navarro 1, 35002 Las Palmas de Gran Canaria, Spain (hereinafter “Paynow” or the “Company”).

 2. Nature of the Services.
Paynow provides services including:

- legal assistance for passengers
- airline claim management
- support in requesting compensation or reimbursement
- advance payments for certain expenses included in the purchased services.
Paynow services do not constitute insurance policies or insurance products.

 3. Scope of Services.
Paynow services may include assistance in claiming compensation or reimbursement under:

Regulation (EC) No. 261/2004, the Montreal Convention other applicable passenger rights legislation.
Eligibility for compensation depends on the conditions established by the applicable laws.

 4. Customer Obligations.
The Customer agrees to:

- provide accurate and complete information
- provide the documentation required to manage the claim
- not assign the same claim to third parties after authorizing Paynow
- cooperate with Paynow during the claim process.
The Customer is responsible for the accuracy of the information provided.

 5. Payment for the Service.
The Paynow service fee must be paid at the time of purchase.

Any advances or reimbursements provided by the services are subject to:

- eligibility verification
- submission of the required documentation.
Paynow reserves the right to reject requests that do not meet the service conditions.

 6. Cancellation Policy.
The Customer may request cancellation of the service with a full refund up to 48 hours before the scheduled departure time of the flight indicated in the booking.

Cancellation requests must be sent by email to: info@paynowsolution.com

The service cannot be cancelled:

- after the occurrence of a travel disruption
- after the Customer becomes aware of such disruption.
Requests submitted after the allowed timeframe will not be eligible for any refund.

 7. Advances and Payments.
Any advances provided by Paynow services:

- are subject to eligibility verification
- require submission of the necessary documentation may be paid within the timelines indicated in the service conditions.
The advance represents an early payment of amounts potentially recoverable from the airline.

 8. Limitation of Liability
Paynow shall not be liable for:

- indirect damages
- consequential damages
- indirect financial losses.
Paynow’s total liability shall in no event exceed the amount paid by the Customer for the service.

 9. Fraud Prevention.
Paynow reserves the right to verify the authenticity of the documents provided by the Customer.

In case of suspected:

- fraud
- false documentation
- attempts to obtain payments not legitimately due
Paynow may:

- suspend the claim
- request additional documentation
- reject the payment
- report the case to the competent authorities.
 

10. Personal Data Protection.
Personal data provided by the Customer will be processed in accordance with Regulation (EU) 2016/679 (GDPR) and applicable data protection laws.

Data may be shared with:

- lawyers
- consultants
- technical partners
- solely for the purpose of managing the service and the claim.

 11. Governing Law.
This agreement shall be governed by Spanish law.

Any dispute relating to the interpretation or execution of this agreement shall fall under the jurisdiction of the courts of Las Palmas de Gran Canaria, without prejudice to mandatory consumer protection laws.
